These terms govern your use of riseandshape.com and any order you place with us. By using the store or placing an order you accept them. Please read them before you buy.

1. Who can order

You must be at least 18 years old, or the age of majority in your state, and able to enter into a binding contract. We ship to addresses in the United States only.

2. Products and descriptions

We describe our products as accurately as we can. Screens render colour differently, so the exact shade you receive may vary slightly from the photographs. Measurements in the size chart are given as a guide and allow for normal manufacturing tolerance. The Everyday Brief is a garment, not a medical device: it does not treat, cure or prevent any condition, and it does not cause weight loss.

3. Prices, taxes and availability

Prices are in U.S. dollars and can change at any time before you order. Sales tax, where it applies in your state, is calculated and shown at checkout before you pay. Bundle prices apply automatically in the cart at the quantities shown on the product page. If an item turns out to be unavailable after you order, we will tell you and refund you in full.

If an obvious pricing or description error appears on the store, we may cancel the affected order even after it is confirmed, and we will refund you in full. We will never charge you more than the price you agreed without asking you first.

4. Orders and payment

Your order is an offer to buy. The contract is formed when we send the shipping confirmation. We may refuse or cancel an order where we suspect fraud, where the order breaches these terms, or where we cannot ship to the address given. Payment is taken at checkout through our payment providers.

5. Discount codes

Discount codes are for a single use per customer unless stated otherwise, cannot be exchanged for cash, and cannot be combined unless we say so. We may withdraw a code at any time. Codes obtained by abuse or automated means will be cancelled.

6. Shipping, returns and refunds

Delivery times, costs and what happens if a parcel is late or lost are set out in our Shipping policy. Because our products are intimate garments, all sales are final except for items that arrive damaged, defective or incorrect; the details are in our Refund policy. Both policies form part of these terms.

7. Your account and your conduct

You are responsible for keeping your account details confidential and for everything done through your account. You agree not to use the store to break the law, to interfere with its operation, to scrape or copy it automatically, to resell our products as new without our agreement, or to submit false information.

8. Reviews and content you send us

If you send us a review, a photo or a video, you confirm it is your own, that it is truthful, and you give us a free, worldwide, non-exclusive licence to publish and adapt it on the store and in our marketing. We may remove any content at our discretion. We do not pay for reviews and we do not remove a review because it is unfavourable.

9. Our intellectual property

The Rise&Shape name, logo, texts, photographs, videos and the design of this store belong to us or to our licensors. You may not copy, reproduce or use them without our written permission.

10. Disclaimers

THE STORE AND THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE STORE WILL BE UNINTERRUPTED OR ERROR-FREE. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSSES. Nothing in these terms limits liability for fraud, for death or personal injury caused by our negligence, or for anything that cannot be limited by law. Some states do not allow these limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to hold us harmless from claims arising out of your breach of these terms or your misuse of the store.

13. Governing law

These terms are governed by French law, where our business is established. This does not deprive you of the protection of the mandatory consumer laws of the U.S. state in which you live, which continue to apply to you in full.

14. Changes

We may update these terms. The version in force is the one published here on the day you order, and the date at the top shows when it was last changed.
